Several media outlets have reported on the three lawsuits filed by the Lowenstein Center for the Public Interest seeking compensation for the physical and emotional trauma experienced by migrant families whose children were taken away during the Trump administration. In Law.com, Catherine Weiss, Chair of the center, says: “These families fled violence and persecution in their home countries only to encounter U.S. government agents who further abused and terrorized them;” adding: “And when the government undertakes to cause harm, and succeeds in that effort, as it did here, it needs to pay damages to people as a deterrent. The government should never get off scot-free when it sets out to cause harm to families.” In Documented, Weiss describes the trauma inflicted on the families: “These families fled violence and persecution in their home countries only to encounter U.S. government agents who further abused and terrorized them. U.S. government agents tore young children away from their parents, refused to provide any information about their whereabouts or their welfare, and failed to track separated families so that they could eventually be reunited.” Weiss notes that “across the country, more than two dozen lawsuits have been filed on behalf of families affected by the Trump administration’s family separation policies.” In other similar suits in other jurisdictions, the government has moved to dismiss these kinds of claims, but Weiss hopes that these filings are treated differently and that “they start really taking these cases seriously.” The New Jersey Monitor also covered the story. Weiss is joined by Natalie J. Kraner and Jennifer Fiorica Delgado as co-lead counsel in these cases.
